Presence of Other Animals
Tenants acknowledge they have been informed that dogs and/or other animals reside at neighboring units and use the shared yard.
Responsibility for Tenant’s Animals
Any dog or animal belonging to a tenant must remain supervised and under control at all times while in the shared yard. Tenants are responsible for immediately cleaning up after their animals and preventing disturbances, damage, or aggressive interactions involving their animals.
No Guarantee of Behavior of Other Animals
Landlord makes no representations or guarantees regarding the behavior, temperament, or actions of other residents’ animals. Tenants understand use of the shared yard is at their own risk.
Hold Harmless & Release of Liability
Tenants agree to indemnify, defend, hold harmless, and release Landlord, The Home Company, LLC, the property owner, and their agents from any liability, claims, damages, or injuries arising from:
(a) the presence or actions of other tenants’ animals;
(b) interactions between animals belonging to different households;
(c) a tenant’s or tenant’s guests’ use of the shared yard;
(d) any injury to tenants, guests, or animals occurring in the shared yard.
Compliance With Lease
All existing lease terms, including pet rules, damage liability, and noise/disturbance provisions, remain in full effect and apply in addition to this Addendum.
